Constitutional governance & amendments

Article 43 — Constitutional Governance & Amendments · Status LOCKED · Version 1.0 · Locked August 4, 2026. This page documents constitutional policy. It creates no new governance body and no new authority: amendments, versions and history are governed by the existing constitutional governance system.

43.1

Purpose

This Article establishes how the InkHub Constitution may evolve over time, so that InkHub's founding values are preserved while the marketplace adapts thoughtfully to future circumstances.

Article 43 governs constitutional evolution — not ordinary product development. Constitutional change runs through the existing constitutional governance system under Article 24; no parallel governance authority exists.

The amendment register, approval workflow, participant notices and version history live in the constitutional governance system established by Article 24. Article 43 governs how that system may be used — it does not replace it.

43.2

A living Constitution

The InkHub Constitution is a living document. It may evolve as:

  • Technology advances.
  • The tattoo industry changes.
  • Marketplace experience grows.
  • New challenges emerge.
  • Better solutions are discovered.

Evolution must strengthen the marketplace rather than abandon its constitutional principles. Constitutional text is never modified automatically by technology, metrics, trends, AI recommendations or business conditions. Constitutional change remains human-governed at every step.

Principle before policy

The Constitution remains focused on:

  • Governance.
  • Trust.
  • Long-term direction.

Operational detail belongs elsewhere:

  • Product Blueprint

    Product design, feature scope and delivery sequencing.

  • Marketplace Policies

    Day-to-day marketplace rules, pricing details and operating settings.

  • Operations Manual

    Internal procedures, support handling and administrative practice.

Temporary product settings, pricing details, implementation instructions, interface behaviour, technical configuration and ordinary operating procedures are operational. They are never promoted into constitutional governance unless the Constitution explicitly requires it, and operational documents never substitute for constitutional authority.

43.4

Responsible amendments

An amendment is introduced only when it reasonably meets at least one constitutional justification:

  • Improves fairness
  • Strengthens trust
  • Enhances participant experience
  • Protects creators
  • Improves marketplace sustainability

Every amendment record documents:

  • Proposed amendment text.
  • Article affected.
  • Reason for the amendment.
  • Constitutional purpose.
  • Which Article 43.4 justification applies.
  • Proposed by whom.
  • Review status.
  • Decision.
  • Written reasoning.
  • Effective version and date.

Safeguards that cannot be waived:

  • A proposal is not an adoption. Proposing an amendment never alters the Constitution.
  • No AI system may approve, enact or influence a constitutional amendment.
  • No automated workflow may approve or enact a constitutional amendment.
  • A constitutional amendment requires explicit, authorised human action recorded in the governance history.
43.5

Constitutional stability

The Constitution must not be revised solely because of:

  • Short-term revenue opportunities.
  • Temporary commercial pressure.
  • Promotional advantage.
  • Investor preference.
  • Popularity.
  • Competitive pressure.
  • Temporary business conditions.

The Constitution shall not be revised solely for any of these reasons. Long-term marketplace integrity takes precedence over temporary advantage. This safeguard is constitutional governance exercised by authorised people — it is not a financial score and not an automatic rejection rule.

43.6

Historical preservation

When an Article is amended, prior versions are preserved for historical reference wherever reasonably practical. Prior constitutional versions are never silently overwritten: a revision writes a new record and supersedes the previous one, and the governance history is append-only. The evolution of the Constitution remains part of InkHub's permanent institutional history.

Historical records preserve, where available:

  • Article number.
  • Prior version.
  • New version.
  • Date.
  • Amendment reason.
  • Decision record.
  • Authorised decision maker.
  • Effective date.

The published record — versions, amendment history and interpretations — is available on the official Constitution page.

43.7

Stewardship

Every generation of InkHub leadership serves as a steward of the Constitution. Stewardship is responsibility, not unchecked authority.

  • Authority to improve the marketplace.
  • Responsibility to preserve its core values.

What stewardship never includes:

  • No special leadership privileges.
  • No permanent founder privileges.
  • No exception allowing leadership to bypass constitutional procedure.

The Constitution should evolve with wisdom, never with convenience.

Lasting institutions improve thoughtfully while remaining faithful to their foundational purpose.
